Antitrust Issues in US Agriculture - December 2009

The recent rapid consolidation and high level of concentration in some key US agriculture markets has seen a renewed focus on competition issues in 2009. With both farmers and agribusinesses facing a downturn in profitability due to the recession, the incentive for further consolidation at all levels of the value chain will continue. However, these companies will face much greater scrutiny and must prepare for the possibility that the Department of Justice or Federal Trade Commission will intervene to either block these proposals outright or place more stringent and onerous conditions on the parties involved.
